Notice to amend a Management Order
(Section 44 of the Contaminated Land Management Act 1997)
Notice Number 20204440; Area Number 3183
The land to which this notice applies, is declared as “significantly contaminated land” (Declaration No. 21089) and is the subject of a Management Order (Order No. 20181401, as amended by Notice No. 20194429) issued by the Environment Protection Authority (EPA). The Management Order directs the recipient of the order to implement works that will prevent further offsite migration of arsenic in groundwater. The recipient of the order has completed the construction component of the remedial works (Item 2(b) of the Management Order) and submitted a validation report for the works (Item 2(c)) on 24 December 2019. The Management Order requires a Site Auditor to review the works and to submit a Site Audit Statement and Site Audit Report (Item 1(b)) within 6 months following the submission of the validation report, i.e. by 24 June 2020.
The recipient of the Management Order has requested a 3-month extension to the milestone date for submitting a Site Audit Statement and Site Audit Report. The requested amendment is due to the Site Auditor being assigned to state emergency works in rural NSW (drought response) and major NSW infrastructure projects. The requested amended milestone date is 24 September 2020. The EPA has reviewed the request and hereby grants the requested amendment to the milestone date. The EPA notes that remedial works are effectively complete and considers that the extension is justified to enable the Auditor to address emergency works.
Management Order No. 20181401 is amended as set out in the table below:
