Licence Condition
By 1 January 2013, the licensee must submit to the Manager of the South East Region of the EPA, their nomination of a preferred option for the beneficial reuse and disposal of treated effluent from the Merimbula Sewage Treatment Plant, and submit a capital works plan for that option. Specifically the licensee must: a) in consultation with stakeholders, nominate the licensee’s preferred option/s for beneficial reuse and disposal of treated effluent; b) outline the practical, technical and environmental reasons for selection of the preferred option/s, including the practical, technical and environmental rejection of other options; c) identify further investigations required for the nominated option/s, and outline proposed timeframe to undertake these investigations; and d) submit a costed capital works plan based on the preferred option/s, which includes, but is not limited to, a timetable for the implementation of the option/s (including design and construction), and identifies what approvals will be required.
By 1 July 2013, the licensee must have obtained the required approvals for construction of the preferred option/s and commenced design and construction in accordance with the capital works plan.      
By 30 June 2017, the licensee must: a)  have obtained the necessary approvals, constructed and commissioned sewage treatment plant upgrades to improve effluent quality for disposal and reuse, with a particular focus on reduced nutrients and improved disinfection; and b)  have obtained the necessary approvals, constructed and commissioned a deep water ocean outfall for the disposal of treated effluent from Merimbual Sewage Treatment Plant.
By 30 June 2017, the licensee must: a)  have obtained the necessary approvals, constructed and commissioned a deep water ocean outfall for the disposal of treated effluent from Merimbula Sewage Treatment Plant; and b)  have obtained the necessary approvals, constructed and commissioned upgrades to the sewage treatment plant to ensure that the treated effluent quality is commensurate with the standards required in condition (a) above.
The licensee must, by 31 March 2021: a)  Have completed than Environmental Impact Statement (EIS) and Concept Design for a deep water ocean outfall and STP upgrade for the disposal of treated effluent from the premises.
The licensee must, by 31 March 2023: a)  Have obtained the necessary approvals, constructed and commissioned a deep water ocean outfall for the disposal of treated effluent from the premises; and b)  Have obtained the necessary approvals, constructed and commissioned upgrades to the STP to ensure that the treated effluent quality is commensurate with the standards required in condition ‘a)’ above
