Variations to environment protection licences under section 58 of the Protection of the Environment Operations Act Licences

Under section 58 of the Protection of the Environment Operations Act 1997 licensees may apply to the Environment Protection Authority (EPA) for a variation in their licence conditions.

Also the EPA may vary licences under section 58 of the Protection of the Environment Operations Act 1997. Relevant material is available for the variation to an environment protection licence for Endeavour Coal, and for the proposed variation of the environment protection licence for Clarence Colliery.

Endeavour Coal has applied to the EPA under Section 58 of the Act to vary their licence No. 2504 to authorise the limited discharge of certain pollutants from West Cliff Mine to Brennans Creek, a tributary of the upper Georges River. The EPA has considered public submissions, and issued a Notice under s. 58 to vary the licence.

For Clarence Colliery, after considering the public submissions, the EPA is proposing to vary the licence for Clarence Colliery with respect to limits on nickel, salinity, and temperature of the discharge, as well as introduce a legally-binding Pollution Reduction Program requiring the company to reduce the concentration of pollutants in the discharge.
